Welcome to BUILDA, a platform connecting construction professionals with customers looking to build, renovate or repair their property. BUILDA is owned and operated by BUILDA LLC, a company registered in the United States.

These Terms of Use govern your use of BUILDA and any related services provided by BUILDA. By accessing or using BUILDA, you agree to these Terms of Use. If you do not agree to these Terms of Use, you may not use BUILDA.

• 1. DEFINITIONS

  
  

  In these Terms of Use, the following definitions shall apply:

  • "BUILDA" refers to the mobile application or website operated by BUILDA LLC, and any related services or features provided by BUILDA.
  • "Services" refers to any services provided by BUILDA to users, including but not limited to matchmaking services for construction professionals and customers, messaging services, payment services, and dispute resolution services.
  • "Construction Professional" refers to any person or company registered with BUILDA who provides construction services to customers through BUILDA.
  • "Customer" refers to any person or company registered with BUILDA who is seeking construction services from Construction Professionals through BUILDA.

• 2. USE OF BUILDA

  
  
  • You may use BUILDA only for lawful purposes and in accordance with these Terms of Use.
  • You must be at least 18 years old to use BUILDA.
  • You are responsible for ensuring that all information you provide to BUILDA is accurate, complete and up-to-date.
  • You may not use BUILDA to:
    • Engage in any illegal activity or violate any applicable law or regulation;
    • Use BUILDA to harass, intimidate, threaten or stalk other users;
    • Use BUILDA to distribute spam or unsolicited messages;
    • Use BUILDA to transmit any viruses, malware or other harmful code;
    • Interfere with the proper functioning of BUILDA, including but not limited to overloading or flooding the platform with requests or spam;
    • Attempt to gain unauthorized access to BUILDA or any user's account;
    • Use BUILDA to impersonate another person or entity.

• 3. ACCEPTANCE OF TERMS

  
  

  By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use the Platform. BUILDA reserves the right to modify or update these Terms at any time and without prior notice to you. Your continued use of the Platform after any such modification or update shall constitute your acceptance of the revised Terms.

• 4. REGISTRATION AND USER ACCOUNTS

  
  
  • To use BUILDA, you must register and create a user account.
  • When registering, you must provide accurate and complete information about yourself or your company.
  • You are responsible for maintaining the confidentiality of your user account and password, and for all activities that occur under your account.
  • You may not share your user account or password with anyone else.
  • You agree to notify BUILDA immediately if you become aware of any unauthorized use of your account or any other security breach.

• 5. SERVICES FOR CONSTRUCTION PROFESSIONALS

  
  
  • Construction Professionals may use BUILDA to find customers seeking construction services.
  • Construction Professionals may create a profile on BUILDA, which may include information about their qualifications, experience, and past work.
  • BUILDA may use algorithms to match Construction Professionals with potential customers based on the information provided in their profile and the requirements of the customer.
  • Construction Professionals are responsible for providing accurate and complete information about their qualifications and experience.
  • Construction Professionals agree to communicate with customers only through BUILDA and not to circumvent the platform by seeking to communicate outside of BUILDA.
  • Construction Professionals agree to provide the services to customers in a professional and workmanlike manner and in accordance with any agreement between the Construction Professional and the customer.

• 6. PAYMENTS AND REFUNDS

  
  

  Any payments made to list your service on the Platform are non-refundable. If you choose to list your service on the Platform, you agree to pay the applicable fees. BUILDA reserves the right to modify the fees at any time and without prior notice to you. In the event that BUILDA terminates your account for any reason other than a breach of these Terms, BUILDA shall not refund to you any prepaid fees for the remaining portion of the then-current term.

• 7. ACCEPTABLE USE POLICY

  
  

  Only construction-related services are allowed on the Platform. You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to use the Platform in any manner that could damage, disable, overburden, or impair any BUILDA server, or the network(s) connected to any BUILDA server, or interfere with any other party's use and enjoyment of the Platform.

• 8. USE OF GOOGLE MAPS

  
  

  Some features of the Platform may use Google Maps. By using the Platform, you hereby agree to comply with the Google Maps Terms.

• 9. MODIFICATION AND TERMINATION OF PLATFORM

  
  

  BUILDA reserves the right, at any time, to modify, suspend, or discontinue the Platform (in whole or in part) and/or the services provided in the Platform (in whole or in part) with or without notice to you. BUILDA shall not be liable to you or any third party for any such modification, suspension, or discontinuance of the Platform or the services provided in the Platform.

• 10. INTELLECTUAL PROPERTY

  
  

  The Platform and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by BUILDA or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You are not permitted to use any BUILDA trademark, logo, or service mark without our prior written consent.

• 11. DISCLAIMER OF WARRANTIES

  
  

  The platform and the services provided in the platform are provided "as is" and without warranty of any kind. builda disclaims all warranties, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.

• 12. LIMITATION OF LIABILITY

  
  

  Builda shall not be liable for any damages of any kind arising from the use of the platform or the services provided in the platform, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

• 13. INDEMNIFICATION

  
  

  You agree to indemnify and hold harmless BUILDA, its affiliates, and their respective officers, directors, employees, and agents from any and all claims, damages, expenses, and costs (including reasonable attorneys' fees) arising from your use of the Platform.
